Henry Nelson, 81, from Liverpool, suffered serious injuries when he was struck by Finnan's black Range Rover in January, and died in hospital five weeks later.

"In every case where a matter is referred to the CPS consideration is given to all the evidence," said a spokesman for the Crown Prosecution Service.

"This is to ascertain if it is in the public interest to proceed and there is a reasonable prospect of conviction. Only if there is sufficient evidence can we proceed."

An inquest into Mr Nelson's death will take place on 24th November when Finnan will be called as a witness.
